AQUA FANTASY AQUA PARK
ONLINE SALES CONTRACT

On one part, ……………………………………..  (real and/or legal person hereinafter referred to as the “Client”), which is resident at the address of  ………………………………, and on the other part, the “AQUA FANTASY” enterprise (hereinafter referred to as the “Aquapark”), which is resident at the address of  Pamucak Oteller Bölgesi Selçuk – İZMİR, of  Özel Büyük Kolej Eğ. Bas. Yay. Tic. ve San. A.Ş., which is resident at the address of Hülya sok. No: 7 G.O.P. – ANKARA; the contract parties, which will both be referred to as the “Parties” in the forthcoming articles; by taking into consideration that, this hereby contract is an official offer, contains all the conditions for presentation of aquapark sales service via internet, all the below specified conditions are binding (on the parties, certain conditions are on the web site of www.aquafantasy.com, and cannot be changed by the client, have concluded this hereby contract within the frame of below conditions.

1. SUBJECT OF THE CONTRACT AND PARTICULARS OF THE SERVICE
1.1. In accordance with this hereby contract, in case the Client purchases the aquapark sales service via internet in accordance with the conditions, Aquapark is obliged to put into service the one-day aquapark utilization (will be referred to as the “Service” in the future).
1.2. Upon signing of this hereby contract, the Client will confirm that, it has been notified on aquapark utilization and operating rules, daily entrance selling rules and tariffs.
1.3. Starting with the conclusion of this hereby contract, Aquapark will confirm the Client’s request.
1.4. This hereby contract is in respect of one-day utilization of the AQUA FANTASY AQUAPARK enterprice, which is established at the above specified address, and technical specifications of which are declared on the web site of www.aquafantasy.com. Details of the enterprice, and services provided in the enterprice are as explained on the web site. The Client represents and acknowledges that, before signing this hereby contract, it has examined the Aquapark and rules and conditions (“fact sheet) necessary to be complied with in the park, and has information about coverage and exceptions of the services given.

2. FORM OF SALE OF AQUAPARK DAILY ENTRANCE
2.1. Sale of daily entrance in order for utilization of the service, can be realized by means of payment of the charge with credit card by filling in the form on the web site of www.aquafantasy.com. The amount to be withdrawn from credit card must correspond to the number of clients to enter into the facility. Upon payment of the charge an “order” number is given to the client via internet. On entrance into the facility, the client is required to take an entrance card by presenting his/her order number to the officials.
During these transactions, no processing charge is collected from the client, except for the payment of the charge with credit card.
2.2. After the Client has confirmed his/her request, online sales contract gains validness with all its terms and conditions, and will be in force during the related season in which the daily entrance has been purchased.
2.3. In case the daily entrance  that the CLIENT has acquired, is a discounted daily entrance  (“promotional daily entrance ”), the Client represents that, those daily entrances might have special conditions, and he/she has accepted the rules and conditions published on the web site of www.aquafantasy.com, in respect of the promotional daily entrances.
2.4. The Client accepts the accuracy of the information that he/she has given during online registration. In case information given by the Client are incorrect, and/or in case the age of the child if any is identified to be different from the identity card requested by the authorized person during the online registration, the necessary changes will be made, and the Client will bear the price difference.
2.5. Daily entrances offered for online sale are also valid for the season of 2024, they can in no way be utilized out of the specified dates.

3. SERVICE CHARGE AND MODE OF PAYMENT
3.1. VAT included sale charge of one-day aquapark service is  Euro ( Euro). Online sale service charges are the same as the pay desk prices except for the promotion periods and/or general price increases. The Client will not pay any additional charge except for this hereby price for the online sale service charge.
3.2. Aquapark reserves the right to make change in the service charge on the dates when the daily entrance is offered for sale.
3.3. During the payments made with credit card by means of online daily entrance sale system, the Client will enter his/her card information into the system.
3.4 Aquapark will in no way be held responsible for the damages occurred in consequence of the fact that information, documents and secrets are known to third persons by reasons such as damaging programs, program system problems arising from the Client’s computer, carelessness of the Client, credit card’s being utilized by third persons, and the Client’s own mistake.
3.5. The invoice will be given to the Client on entrance to Aquapark. If the Client doesn’t take the invoice on entrance, Aquapark will not be held responsible for that the invoice is not taken.

4. MODE OF RETURNING OF THE PAYMENT
4.1. The Client will be able to use the daily entrance at any time during the season, on condition that utilization remains within the season in which online purchasing has been made, and on condition that the daily entrance has been used for one-off entrance as one-day utilization.
The Client, who has not used the daily entrance and has not entered into the facility, can request for return of the daily entrance without any justification, within a period of 7 days starting from the date on which he/she has purchased the daily entrance in electronic environment and online sales contract has gained validity in this way. Upon this kind of a request, Aquapark will return the daily entrance as specified below in article 4.3. within 10 days starting from the date on which the request is received.
Daily entrance price paid by the Client, who has not used the daily entrance and has not entered into the facility during the whole season, will be returned to the Client with %15 of a deduction, on condition that the Client applies for it within 7 days starting from end of the season when the daily entrance has been closed to utilization.
4.2. No daily entrance return is made after the Client has entered into the facility.
4.3. During online sale registration, returning of the payments made with credit card will be deposited into the credit card within 10 days.

5. MODE OF UTILIZATION OF AQUAPARK
5.1. The Client, who has purchased Aquapark daily entrance by online sales processing, will submit the order number of the daily entrance.
During the Client’s entrance into the facility his/her age and identity card will be checked. The Client will be the only responsible for the legal and penal sanctions which might be encountered for the reason that the Client has given inaccurate information. The Client acknowledges and undertakes to pay for the damages, daily entrance price differences and similar things that Aquapark incurs by reason of giving inaccurate information.
5.2. Whenever he/she arrives at Aquapark, the Client acknowledges and undertakes in advance to comply with the business hours of the Aquapark. The Client acknowledges and undertakes in advance that, repeated entrances and exits cannot be made after entrance to the aquapark, and otherwise he/she will be obliged to buy a daily entrance again.
5.3. During online sale registration, the whole price will be collected. 
5.4. Pets will not be accepted by the aquapark.
5.5. Aquapark reserves the right to change Daily Utilization Conditions without giving any notification.
5.6. In case the Client gives up receiving the service for a reason after entrance into the Aquapark, except for that Aquapark has not fulfilled its responsibilities, the payment will not be returned.
5.7. On entrance into the Aquapark, the Client will submit to the employer; his/her credit card used for the payment when making online registration, or copy of front side of this credit card. Responsibility due to the losses/damages arising from the fact that the Client has not fulfilled these responsibilities will belong to the Client.

6. RESPONSIBILITY OF THE PARTIES
6.1. Aquapark cannot be held responsible for the problems arising from force majeure events and the Client’s own fault, after the Client has entered into the Aquapark. In cases where the problem arises from Aquapark, in accordance with this hereby contract, Aquapark will compensate the damages by either “returning back the service”, or by “paying for the service”, or by “offering additional service and/or alternative service to the Client”. Additional service, or aquapark utilization service being accepted by the Client, will mean that the Client has waived his/her right to request for return of the daily entrance price.
6.2. In accordance with this hereby contract, in case of allegations that Aquapark has not fulfilled its obligations of offering service in part or in whole, or in case of disputes in this respect, related provisions of the Law on Protection of Consumer, and Code of Obligations will apply.
6.3. In cases where the service has not been provided to the Client in the qualification specified in this hereby contract, the Client will inform his/her complaint in written to the Customer Services Representative at the entrance of the Aquapark, otherwise, the service offered by the Aquapark will be deemed to have been offered perfectly and timely.
6.4. In cases where the Client violates any article of the contract and/or aquapark utilization rules and conditions, the Client acknowledges and undertakes to compensate for any damages that the Aquapark has incurred in consequence of this breach.

7. OTHER PROVISIONS
7.1. Unpredictable situations such as unfavorable weather conditions, technical problems, strike-lockout, terror, military operation, flood, fire etc. will be regarded as force majeure events. In case these types of events occur, the Aquapark may stop giving service in whole or temporarily.
7.2. Addresses of the parties that they have declared in this hereby contract, are their residence addresses, and notifications will be made to these addresses. In case any change occurs in the specified addresses, this will immediately notified to the other party. Otherwise, notification made to the address specified in this hereby contract will be deemed to be valid.
7.3. When disputes to arise in accordance with this hereby contract are necessary to be resolved, Ankara Courts and Execution Offices are authorized.
7.4. This hereby contract will be concluded by means of the internet address specified in the related article above, it consists of totally 7 articles, and it will enter into force on the date when online sales process is undersigned by the parties.
